It’s been 6 years since Jackson native Demetria Bracey was murdered. This holiday season her parents say they've been forced to relive their painful loss.
The state supreme court overturned the conviction for David Williams-- the man convicted of her murder. Williams' lawyers had appealed when he was found guilty saying that the suicide pact theory was never explained to the jury.
He's been out on bail and is scheduled to be retried in February.
Williams is accused of stabbing his girlfriend Bracey then putting her body in a closet.
She graduated from Murrah High School and was a student at Ole Miss when she was killed.
“Why is he out? If I had did that I guarantee I would still be locked up" says Jerome Bracey, Demetria’s father
“His attorney had the audacity to ask me if I would accept a plea bargain and charge him with manslaughter instead of kidnapping" says Glenda Hill, Demetria’s mother
David Williams’ lead defense attorney tells News Channel 12:
"Williams did not get to fairly advance and fully factually develop his defense that he and ms Bracey had a suicide agreement in the first trial"... the statement goes on to read..
"of their loved one and their day-to-day life without her. Our sympathies continue to go out to all of those touched by Demetria's death. "
