Rapist freed on $100K bond in child molestation case; D.A. Plans Second Trial

Thomas Tubbs, 56, is out on bond after a Warren Co. jury deadlocked in a child molestation case. A jury voted 10-2 to find him guilty.

District Attorney Ricky Smith says Tubbs will have another trial. He says it could happen as early as March 2011.

Tubbs is accused of molesting a 3-year old girl in December 2009. In 1993, he pled guilty to raping a 10-year girl in Warren County. He served 10 years in prison and is now on the Mississippi's sex offender registry.

Smith says there's overwhelming evidence in the case including DNA matches. But he doesn't know why the jury deadlocked.

He says he plans on presenting the same evidence in the next trial.
